ConocoPhillips Wood River refinery sued over contractor's fall from stadium light tower

A man has filed suit against the company that he claims failed to adequately design a device, which caused him to fall and sustain injuries.

David Digirolamo claims he was working for URS Corporation at defendant ConocoPhillips's Wood River refinery. As part of his job duties, Digirolamo was required to work on the platform of a stadium light tower, according to the complaint filed in Madison County Circuit Court.

Digirolamo does not specify how he fell, but does say that he incurred neck, shoulder and back injuries because of the incident. He also suffered pain, mental anguish, disability and disfigurement; incurred medical costs; and lost wages, the suit states.

ConocoPhillips negligently failed to provide a safe stadium light tower and failed to prevent Digirolamo from working on a tower that it knew to be unsafe, the complaint says.

In addition to ConocoPhillips, Digirolamo names American Equipment Company and Interstate Power Tools and Machining as defendants. Both companies designed the stadium light tower, which was not equipped with steel grating or other slip resistant material and which had bolts protruding from it, according to the complaint.

In his four-count complaint, Digirolamo is seeking a judgment of more than $300,000, plus costs.
