A woman claims she suffered from mental distress after she was nearly hit by a vehicle as she was walking down the sidewalk.
Bridget Brandon filed a lawsuit Aug. 23 in Madison County Circuit Court against Cynthia Javurek.
Brandon claims she was walking north on Seminary Street at 12:48 p.m. on Dec. 29 when defendant Javurek entered into the intersection of Seminary Street and Wood Alley in Alton. However, Javurek failed to yield the right-of-way to Lawrence Nutt, who was traveling south on Seminary Street, and collided with him, according to the complaint.
"The collision described above caused the vehicle operated by defendant Cynthia Javurek to begin traveling towards the area where plaintiff Bridget Brandon," the suit states. "Plaintiff Bridget Brandon began to run to avoid being struck by the vehicle operated by defendant Cynthia Javurek. While running to avoid being struck by the vehicle operated by defendant Cynthia Javurek, plaintiff Bridget Brandon fell and was injured."
Due to her fall, Brandon suffered serious injuries to her head, face and left hand; became sick, sore, lame and disordered; and suffered physical pain and mental distress, the complaint says. She also claims she incurred medical costs and lost wages of $1,823.26.
Brandon blames Javurek for causing the collision, saying she negligently failed to keep a careful lookout, failed to yield the right-of-way and drove too fast.
In her complaint, Brandon seeks a judgment of more than $50,000, plus costs and other relief.
