Complaint accuses doctor of operating on wrong section of patient's back

A man claims his doctor performed a surgery on the wrong section of his back, causing him to suffer permanent pain.

Emmitt Tiner filed a lawsuit July 31 in St. Clair County Circuit Court against Dr. Stephen P. Striegel and SPS Surgical Services.

In his complaint, Tiner alleges Striegel was supposed to perform an anterior interbody lumbar fusion, which is a surgery to relieve lower back pain. However, Striegel - who was working for SPS Surgical Services at the time - failed to perform the surgery on the correct portion of Tiner's body, according to the complaint.

Because of the incident, Tiner suffered mental anguish, disability and disfigurement; incurred medical costs; and lost wages, the suit states. He also was prevented from attending to his usual duties and affairs, the complaint says.

In his complaint, Tiner seeks a judgment of more than $150,000, plus costs.
