City of O'Fallon named in personal injury suit

An O'Fallon resident is suing the city claiming injuries from falling while attempting to cross a street in the spring.

Nancy McCaw, represented by Gregory Shevlin of Belleville, claims the incident took place on March 31 as she attempted to cross the northwest corner of East 3rd and Apple streets.

The suit, filed Aug. 9 in St. Clair County Circuit Court, claims that a nearby sidewalk had been demolished, jackhammered or otherwise altered prior to her falling incident.

McCaw claims the city is negligent for creating an uneven surface for pedestrians to walk on, leaving the sidewalk in disrepair, failing to divert pedestrian traffic from the area and failing to warn of the hazard.

She is seeking in excess of $50,000 in damages for injuries to her shoulder, face and body as a whole.
