The parents of a Granite City woman killed in a motorcycle crash say the bars that served drinks to the operator of that motorcycle are responsible for her death.
Jerry and Shelly Halbrook, as special administrators of the estate of their deceased daughter, Kimura Halbrook, filed a lawsuit June 28 in Madison County Circuit Court against Baum Inc., doing business as 5th Quarter Bar & Grill. Textparty Inc., doing business as Johhny's Side Bar, McDill Inc., doing business as McDill's Pub, and Shooter's Bar & BBQ Inc. are also named as defendants.
According to the petition, Kimura Halbrook was a passenger on a motorcycle ridden by Brandon King in July 2011. They were riding in Collinsville in the early morning hours when King allegedly lost control of the motorcycle and crashed, the complaint states. The Halbrooks say their daughter was thrown from the motorcycle and died as a result of her injuries. They also allege King was drunk at the time of the crash.
The Halbrooks claim King visited several places that night and was served alcoholic drinks. Those bars are said to be the 5th Quarter Bar & Grill on East Main Street, Johnny's Side Bar on East Main Street and McDill's Pub on St. Louis Road, all in Collinsville. King was also allegedly served alcohol at Shooters Bar & BBQ, in O'Fallon.
The plaintiffs accuse the bar owners of violating Illinois' Dram Shop Act, claiming King drank alcohol at these establishments to the point of intoxication prior to the crash, making them liable for the death of their daughter. They seek more than $200,000 in damages plus court fees.
Attorney Katie Hubbard of Edwardsville represents the Halbrooks. They ask for a jury trial.
