Trip over exposed drainage pipe leads to serious injuries, suit claims

A woman claims she was forced to endure surgery after she tripped over an exposed drainage pipe at a Pontoon Beach apartment building.

Sheron Gray filed a lawsuit June 22 in Madison County Circuit Court against Devault Operations, Las Canyon and Melissa Clark.

In her complaint, Gray alleges she was attending a family gathering at 101 Whitsell Way, No. 103, in Pontoon Beach on Aug. 28, 2010, when she began walking back to her car. On her journey to her vehicle, Gray tripped over an exposed drainage pipe, according to the complaint.

In addition to her surgery, Gray incurred medical costs, lost wages, experienced pain and suffering and lost her well-being because of the incident, the suit states. She also missed opportunities and experienced a diminished quality of life, the complaint says.

Gray blames Devault Operations, Les Canyon and the property's manager, Melissa Clark, for contributing to her injuries, saying they negligently allowed an unsafe drain pipe obstruction to remain on their premises, failed to maintain the parking lot in a safe condition and failed to place a warning sign.

In her complaint, Gray seeks a judgment of more than $150,000, plus costs, interest and other relief the court deems just.
