Avis named in rear-end accident on State Street in ESL

An East St. Louis woman claims she sustained numerous injuries after a driver rear-ended her vehicle as she attempted to make a left-hand turn.

Rosie B. Marshall filed a lawsuit May 21 in St. Clair County Circuit Court against Sammy J. Morning and PB Holding Enterprise doing business as Avis Rent-A-Car.

In her complaint, Marshall claims she stopped in traffic on State Street near its intersection with 30th Street waiting to make a left-hand turn on May 22, 2010, when Morning, who was driving a vehicle he had rented from Avis, struck the rear-end of her vehicle.

In addition to her injuries, Marshall experienced great pain and anguish, incurred medical costs and lost wages, according to the complaint.

She says Morning negligently failed to keep a proper lookout, failed to keep his vehicle under proper control, collided with Marshall's vehicle, failed to stop or swerve to avoid a collision and failed to see Marshall's vehicle.

In her two-count complaint, Marshall is seeking a judgment of more than $100,000, plus costs and other relief the court deems just.
