Fariview Heights rear-end accident results in injuries, suit says

A man has filed suit against the driver who he claims rear-ended his vehicle.

David S. Berry claims he was stopped in traffic traveling east on Frank Scott Parkway near North Illinois Street in Fairview Heights on May 5, 2010, at about 7:14 a.m. when defendant Tyler M. King, who was driving a 2001 Chevrolet Trail Blazer behind him, failed to keep proper control of his vehicle and struck the back of Berry's.

Because of the collision, Berry was severely injured, suffered physical pain and mental anguish, incurred medical costs and lost wages, according to the complaint filed May 3 in St. Clair County Circuit Court.

Tyler King negligently failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to take evasive measures to avoid a collision, drove without safe brakes and drove too fast, the suit states.

In addition to Tyler King, Berry names Terry King as a defendant, saying he lent his vehicle to Tyler King knowing he was an incompetent driver.

In his three-count complaint, Berry is seeking a judgment of more than $150,000, plus costs.

He will be represented by Thomas B. Cannady of Cannady and Aubuchon in Belleville.
