Wal-Mart sued over customer's trip in parking lot

A man claims he sustained various injuries, including a dislocated joint, after slipping on snow in Walmart's parking lot.

Mark A. Varble filed a lawsuit April 23 in Madison County Circuit Court against J's Lawn Care, USM and Walmart.

In his complaint, Varble alleges he was visiting Walmart on Jan. 20, 2011, when he slipped on an accumulation of ice and snow on the parking lot.

The complaint does not state the store's location.

Because of his fall, Varble sustained a dislocated right shoulder and a tendon tear, experienced severe pain and mental anguish and incurred medical costs, according to the complaint. In addition, he lost earnings and sustained an impaired ability to enjoy life, the suit states.

Varble names J's Lawn Care and USM as defendants, saying they were hired to remove snow, but failed to eliminate the dangerous conditions, failed to barricade the accumulated snow and ice from the public and failed to warn of the dangerous conditions.

In his three-count complaint, Varble seeks a judgment of more than $150,000, plus pre-judgment interest and costs.
