A Madison County man is suing his auto insurance provider after the company allegedly refused to pay for an accident claim.
Eric J. Kloepper filed a lawsuit April 2 in Madison County Circuit Court against Geico Casualty Company.
According to the complaint, Kloepper had a current insurance policy with Geico in October 2007 which included uninsured motorist coverage. While he was driving in Madison that month, Kloepper says he was hit by an uninsured driver at the intersection of Illinois Route 203 and North Rhodes Street.
Kloepper says he filed a claim with Geico. He says negotiations were held in October 2008, July 2009 and November 2009 during which settlement offers were made by the insurance company. Kloepper contends he rejected those offers and the claim was sent to arbitration. In February 2010, Geico allegedly withdrew from arbitration, pulled its settlement offer and denied Kloepper's claim.
Kloepper accuses Geico of breach of contract and asks to be awarded more than $100,000 in damages for medical expenses plus attorney's fees or asks the Court to compel the insurance company back to arbitration.
