Mayco accused of violating workers' comp law by terminating employee

A Granite County man says he was fired from his job in retaliation for filing a workers' compensation claim for an on-duty injury.

Grayell Slusher filed the wrongful termination complaint against Mayco Industries April 3 in Madison County Circuit Court.

Slusher was working for Mayco in November 2010 and was responsible for numerous tasks including lifting and moving 55-gallon barrels, according to the complaint. On Nov. 29, 2010, Slusher says he was lifting one of the barrels and seriously injured his right knee.

The employee says he reported his injury the same day and filed a workers' compensation claim. Mayco allegedly terminated Slusher's employment with the company on March 3, 2011. Slusher contends he was fired in retaliation for "exercising his right to claim workers' compensation, but for also making a claim for sick leave pay."

Slusher accuses Mayco of violating the Illinois Worker's Compensation Act. He is asking to be awarded more than $50,000 in damages to compensate for lost wages, lost health insurance benefits and lost seniority within the company.

Attorney Morgan Scroggins of Granite City is representing Slusher.
