Passenger sues two drivers claiming they failed to keep vehicles under control in standing water

A man has filed suit against the drivers who he claims caused him to sustain back, neck and right foot injuries during a collision.

Michael Chadwick claims he was riding in the passenger side of a 1998 Mercury Mystique defendant Brittany Rust drove south on Illinois Route 3 at its intersection with Bissell Street on March 4, 2011, when the incident occurred.

"The pavement was wet and there was standing water on the roadway," the suit states. "Defendant Adrienna Robinson attempted to pass in the left lane when her vehicle hydroplaned out of control and struck Defendant Brittany Rust's vehicle, where Plaintiff was a passenger."

In addition to his injuries, Chadwick suffered great pain and mental anguish, endured a disability, lost his normal life and incurred medical costs because of the collision, the complaint says.

He blames Robinson and Rust for causing the collision, saying both women negligently failed to keep their vehicles under proper control, failed to keep a proper lookout, failed to stop in time to avoid a collision, failed to provide proper signals and failed to reduce their speeds to avoid a collision, among other negligent actions.

In his two-count complaint, Chadwick is seeking a judgment of more than $100,000, plus costs.
