A man died after a maintenance cart toppled on him, causing him to asphyxiate, according to recently filed court documents.
Dale Richards filed a lawsuit March 14 in St. Clair County Circuit Court against Clinton Hill Country Club and Clinton Hill.
In his complaint, Dale Richards alleges Scott Richards was working as an assistant grounds supervisor at defendant Clinton Hill Golf Course on March 16, 2010, when the incident occurred as he was driving a Cushman Cart.
"The Cushman Cart that Scott Richards was operating on March 16, 2010, rolled over onto Scott Richards, landing on top of him," the suit states. "Scott Richards was pinned between the ground and the Cushman Cart, making it impossible for Scott Richards to get out from underneath the Cushman Cart. Scott Richards suffered a slow asphyxiation, which resulted in eventual loss of consciousness and subsequent death."
Dale Richards blames Clinton Hill Golf Course for causing his injuries, saying it negligently modified the cart so it could not traverse a grade of more than 33.2 percent and failed to warn Scott Richards of the cart's inability to navigate certain slopes, among other negligent acts.
In his two-count complaint, Dale Richards is seeking an unspecified judgment, plus costs and other relief the court deems just.
