Breach of contract trial to start Tuesday in Hylla's court

A trial is expected to start Tuesday in Madison County Circuit Judge David Hylla's courtroom in a breach of contract case involving the owner of a New Berlin management company suing an Edwardsville fiber optics company.

James T. Mihalich, owner of J2 Mgmt. Inc., filed the lawsuit Jan. 21, 2011 in Madison County Circuit Court against American Fiber Comm LLC and its owner, Thomas M. Allen.

According to the complaint, J2 Mgmt agreed on a mutual release and settlement agreement with American Fiber in February 2010. Part of that contract said J2 would be given a 10 percent commission on work completed by American Fiber within two years of the contract.

When American Fiber sold fiber optics for more than $1 million to Clearwave Communications in 2010, J2 claimed it was owed more than $100,000. Mihalich alleges American Fiber refused to pay the commission.

Mihalich is asking for the amount he says his company is owed, plus five percent in interest.

Attorneys Philip H. Hamilton and Ebony R. Huddleston of Godfrey are representing Mihalich.
