An additional two asbestos cases have been added to the growing docket in St. Louis Circuit Court.
At the beginning of this month, two new complaints were filed in the 22nd Judicial Circuit in the City of St. Louis. The Simmons firm of Alton brought both of them.
Mary Dunkin sued 12 defendant corporations on Feb. 7 while Dora and Jerry Wilkerson filed a lawsuit against 35 defendant corporations. Neither Dunkin nor the Wilkersons specify where they reside.
Dunkin and the Wilkersons will be represented by Shane F. Hampton, Courtney H. Gregory, Myles L. Epperson and William A. Kohlburn of Simmons, Browder, Gianaris, Angelides and Barnerd in Alton.
In her complaint, Mary Dunkin alleges the defendant companies caused her recently deceased husband, Patrick Dunkin, to develop mesothelioma after his exposure to asbestos-containing products throughout his career as a machinist mate and auto mechanic at various locations from 1966 until 2009.
In their complaint, the Wilkersons allege Dora Wilkerson developed mesothelioma after she worked as a computer programmer and cashier at various locations from 1965 until 2010.
The defendants should have known of the harmful effects of asbestos, but failed to exercise reasonable care and caution for the plaintiff's safety, the suits state.
As a result of their asbestos-related diseases, Dunkin and Dora Wilkerson became disabled and disfigured, incurred medical costs and suffered great physical pain and mental anguish, the complaint says. In addition, they became prevented from pursuing their normal course of employment and, as a result, lost large sums of money that would have accrued to them, the plaintiffs claim.
Because of Patrick Dunkin's death, his family has incurred funeral costs and has been deprived of his support and society.
In her four-count complaint, Mary Dunkin is seeking actual and compensatory damages of more than $50,000 and punitive and exemplary damages of more than $50,000, plus other relief the court deems just.
