Eye injuries claimed in rear-end accident with concrete mixer truck

A man has filed suit against the driver who he claims rear-ended the truck in which he was riding, causing him to sustain serious eye injuries.

Clark Bowman claims he was riding as a passenger in a 2009 International Durastar on May 3, 2010. Travis Boylen was driving the Durastar west on Nine Mile Road at its intersection with Lead Line Road in North Otter when defendant Scott L. Loeschner, who was driving a loaded concrete mixer truck for defendants Curry Ice and Coal and Community Ready Mix of Jacksonville, rear-ended the truck, according to the complaint filed Jan. 31 in Madison County Circuit Court.

Because of the collision, Bowman now suffers from vertical double eye vision, limitations of his eye muscle and edema, the suit states. In addition, he suffered great pain, anguish and disability; lost his normal life; and incurred medical costs, the complaint says.

He blames Loeschner for causing the collision, saying he negligently failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to stop to avoid a collision, failed to give a proper signal to warn of a collision and drove without adequate brakes.

In his three-count complaint, Bowman is seeking a judgment of more than $150,000, plus costs.
