Ford asks to apply previous discovery in suit claiming F-150 accelerated into tree against driver's will

Mudge

Ford Motor Co. is asking that discovery taken in a previous action be entered in a recent suit filed by a man who claims his F-150 pickup accelerated into a tree against his will.

A hearing will be held regarding Ford's motion at 9 a.m. on Jan. 27 in Madison County Circuit Judge William Mudge's courtroom.

The case involves Brian Williams, a motorist who blames Ford for injuries he received while driving a 2004 Ford F-150 pickup truck on Lake Road in Jersey County on Feb. 4, 2005. Williams claims that when he attempted to make a turn, his vehicle "accelerated without Plaintiff's foot being on the accelerator causing him to hit a tree."

The incident occurred because the accelerator remained in the wrong position, the suit filed Nov. 1 claims.

Because of the incident, Williams became sick, sore, lame and disordered and lost his earning capacity, according to the complaint.

In his complaint, Williams is seeking a judgment of more than $50,000, plus costs.

Ford asked for trial by jury on Dec. 6.

Douglas R. Heise filed his appearance as local counsel for Ford on Dec. 16. Michael J. Borree also entered his appearance on Dec. 6 as counsel for Ford.

Lon D. Weaver of Weaver Law Office in Bethalto represents Williams.

Madison County Circuit Court case number: 11-L-1131.
