Terminal Railroad sued over machine operator's repetitive trauma

A railroad worker has filed suit against his employer, alleging he sustained severe and permanent spine, hip and knee injuries because of work he performed.

Jerry West claims he worked as a machine operator for defendant Terminal Railroad Association of St. Louis from 1973 through 2011. Throughout his career, West was exposed to numerous repetitive trauma injuries, causing him to sustain his various injuries, according to the complaint filed Dec. 12 in Madison County Circuit Court.

In addition to his injuries, West suffered great pain and mental anguish, lost money and experienced a diminished earning capacity, the suit states. He also incurred medical costs, the complaint says.

West blames Terminal Railroad Association of St. Louis for causing his injuries, saying it negligently failed to provide him with safe tools and proper equipment, failed to provide him with proper supervision and failed to warn him of hazardous conditions, among other negligent acts.

In his complaint, West is seeking a judgment of more than $50,000, plus costs.

He will be represented by Gregory M. Tobin of Pratt and Tobin in East Alton.

Madison County Circuit Court case number: 11-L-1354.
