O'Fallon accident causes injuries, suit claims

The mother of a minor boy has filed suit against the driver who she claims failed to obey a stop sign and struck the vehicle in which she and her son were riding.

Naiomi O'Sullivan claims she was riding in a vehicle her son, Ryan O'Sullivan, was driving south on North Seven Hills Road in O'Fallon on Dec. 4, 2009, at its intersection with Old Vincennes Trail. Suddenly, defendant James Ostman, who was driving west on Old Vincennes Trail, disregarded a stop sign and struck the vehicle Ryan O'Sullivan was driving, according to the complaint filed Nov. 30 in St. Clair County Circuit Court.

Because of the collision, Naiomi O'Sullivan and Ryan O'Sullivan sustained severe and permanent injuries, experienced great pain and anguish and incurred substantial medical costs. In addition, Naiomi O'Sullivan lost wages and suffered from a diminished earning capacity, the suit states.

Ostman caused the collision by negligently failing to keep a proper lookout, by failing to keep his vehicle under proper control, by failing to brake to avoid a collision, by failing to stop or swerve to avoid a collision and by failing to obey traffic signs, the complaint says.

In her complaint, Naiomi O'Sullivan is seeking a judgment of more than $150,000, plus costs and other relief the court deems just.
