A St. Clair County insurance company wants a Cahokia tractor company to reimburse it for claims allegedly paid on an uninsured vehicle.
Sagamore Insurance Company filed a lawsuit Nov. 14 in St. Clair County Court against Cahokia Haulers Inc.
According to the complaint, an employee of Cahokia Haulers was driving a tractor on Interstate 270 in October 2007 and caused a multiple-car crash. Sagamore alleges the tractor was not insured under the company's policy. However, the insurer says it paid more than $262,000 in claims to the others involved in the crash.
Sagamore claims the tractor company's policy included a provision that requires the insured to pay back any claim paid by Sagamore that it was not obligated to pay. Sagamore accuses Cahokia Haulers of refusing to reimburse the money paid out in claims. The insurance company is asking to be awarded more than $265,000 in damages plus interest and court costs.
