Achiles tendon hurt in trip and fall at Home Depot

Mendillo

A Smithton woman has filed suit against Home Depot, alleging she tore her Achilles tendon after tripping over an obstacle at the store.

Virginia Enlow claims she was shopping at the Home Depot at 5501 Belleville Crossing in Belleville on June 3, 2010, when she fell over an unspecified obstacle and landed on her ankle. Because of the fall, Enlow claims she sustained a torn Achilles tendon.

In addition to her torn tendon, Enlow incurred medical costs; experienced pain, suffering and disability; and lost wages, according to the complaint filed Nov. 8 in St. Clair County Circuit Court.

Home Depot negligently failed to provide a safe place for customers to shop for plants, failed to remove obstacles from the store and failed to warn of obstacles, the suit states.

In addition to Home Depot, Enlow names the store's manager, Erin Dietrich, as a defendant, alleging she failed to train employees to maintain safe walkways for customers.

In her two-count complaint, Enlow is seeking a judgment of more than $100,000.

James R. Mendillo of Freeark, Harvey and Mendillo in Belleville will be representing her.

St. Clair County Circuit Court case number: 11-L-628.
