Mud at construction site causes woman's injuries, suit claims

A St. Clair County woman claims she sustained a fractured ankle and broken fingers after she fell on mud near a construction site.

Barbara and Thomas Sintzel filed a lawsuit Nov. 1 in St. Clair County Circuit Court against Jerry Pruett, Brenda Pruett, Liese Lumber Company and Dumpster Dave.

In their complaint, the Sintzels allege Barbara Sintzel was walking on a street near 7638 Sedona in Belleville on June 1 when she slipped and fell on pavement that was covered in mud.

In addition to her broken bones, Barbara Sintzel incurred medical costs and sustained severe physical and emotional pain and suffering, according to the complaint.

Thomas Sintzel claims he lost his wife's consortium after the incident.

The Sintzels allege negligence against the defendants, saying they failed to supervise work performed at a construction site, failed to prevent mud from accumulating on the street and failed to clean the mud from the street, among other negligent acts.

In their six-count suit, the Sintzels seek a judgment of more than $300,000, plus costs and other relief the court deems just.
