Face, neck and back injuries claimed in Swansea accident

A man claims he sustained face, neck and back injuries after a driver failed to yield the right-of-way at a stop sign.

Roberto Marquez filed a lawsuit Oct. 27 in St. Clair County Circuit Court against Pamela Winslow.

In his complaint, Marquez claims he rode in a vehicle traveling south on Frank Scott Parkway at its intersection with Llewellyn Road in Swansea on Nov. 14, 2010, at about 1:32 p.m. when the incident occurred. Winslow, who drove east on Llewellyn Road, failed to obey a stop sign and plowed into the vehicle in which Marquez was riding, according to the complaint.

In addition to his face, neck and back injuries, Marquez incurred medical costs and suffered disability because of the collision, the suit states. He also experienced pain and suffering, lost wages and suffered an impaired earning capacity, the complaint says.

Marquez blames Winslow for causing the collision, saying she negligently failed to keep a proper lookout, failed to properly apply her brakes, drove too fast, failed to stop at a stop sign, failed to yield the right-of-way to oncoming traffic and drove without adequate brakes.
