Ohio claimant files asbestos suit in St. Clair County

Another asbestos lawsuit has been added to the growing list of cases in St. Clair County's asbestos docket.

Julie Anne Mossburg of Ohio filed an asbestos lawsuit Sept. 23 in St. Clair County Circuit Court against 28 defendant companies.

Mossburg is represented by Randy L. Gori of Gori, Julian and Associates in Edwardsville. Erik Karst, J. Kyle Beale and Matthew T. Wright of Karst and von Oiste in Houston will also be representing her.

In her complaint, Julie Anne Mossburg alleges the defendant companies caused the recently deceased Gary James Mossburg Sr. to develop lung cancer after his exposure to asbestos-containing products throughout his career.

Gary James Mossburg Sr. worked as a bricklayer and tile setter at various residential, commercial and industrial locations from 1966-2006, according to the complaint.

The defendants should have known of the harmful effects of asbestos, but failed to exercise reasonable care and caution for the plaintiffs' safety, the suit states.

As a result of his asbestos-related diseases, Gary James Mossburg Sr. died on Jan. 27, 2010.

Before his death, Gary James Mossburg Sr. became disabled and disfigured, incurred medical costs and suffered great physical pain and mental anguish, the complaint says. In addition, he became prevented from pursuing his normal course of employment and, as a result, lost large sums of money that would have accrued, the plaintiff claims.

In her six-count complaint, Julie Anne Mossburg is seeking economic damages of more than $50,000, a judgment of more than $50,000, punitive and exemplary damages of more than $100,000 and compensatory damages of more than $50,000, plus costs and other relief the court deems just.
