The owner of a Belleville home is suing his insurance company after it allegedly refused to pay when the house was damaged in a fire and then again when property was stolen from inside.

Joseph Netemeyer filed the lawsuit in St. Clair County Circuit Court against Allstate Indemnity Company.

In the complaint, Joseph Netemeyer claims his relative, Jacob Netemeyer, was issued an insurance policy for a house on Bernard Drive in December 2006. About a month later, fire allegedly damaged the house and Jacob filed a claim for damages.

In November 2007, Netemeyer claims several personal items were stolen from the house. He says Jacob, again, filed a proof of loss with Allstate. Netemeyer alleges the insurance carrier partially denied the claim for the fire and completely denied the claim for the theft in April 2008.

According to the complaint, in 2011, Jacob assigned all his right, in regard to the fire and theft insurance claims, to the plaintiff, Joseph Netemeyer. He accuses Allstate of breach of contract for failing to indemnify Jacob Netemeyer for the alleged losses. He contends the insurance company also violated Illinois law by failing to propertly investigate the claims before refusing to pay.
