Harley rider caused Pontoon Beach accident, woman claims

A Collinsville woman claims an Edwardsville motorcyclist is to blame for a head-on crash in the Village of Pontoon Beach.

Carol S. Buffo filed the complaint July 8 in Madison County Circuit Court against John T. Podgajny. Buffo accuses Pogajny of negligence she says caused a crash in the Village of Pontoon Beach in August 2009.

According to the complaint, Buffo was driving her Chevroley Malibu west on Horseshoe Lake Road. As she approached the intersection with Arlington Drive, Buffo says Podgajny drove a Harley Davidson motorcycle across the center line and hit the front of her vehicle. Buffo says she was hurt in the crash.

Buffo contends Podgajny is liable for the crash because he allegedly failed to take the necessary steps to avoid the crash. She says the motorcyclist was driving too fast and not keeping a proper lookout for other vehicles.

Buffo is asking for an undetermined amount of money in damages to compensate for injuries, hospital bills and the inability to go about her usual activities.
