Mudge
A suit over the mechanical bull ride that allegedly led to the amputation of a man's finger is over.
Madison County Circuit Judge William Mudge dismissed plaintiff Timothy Cavins' suit against FunSource Inc. for want of prosecution May 25.
Cavins had sought damages in excess of $50,000 and other relief.
FunSource never answered Cavins' claims and a move by the plaintiff for default judgment was never realized.
Mudge set the case for status or dismissal earlier this year.
However, the judge moved what became the final hearing in the case to May 25 after Cavins phoned the court to inform the judge he was in the hospital following severe storms that moved through St. Louis and the Metro East in April.
Cavins sued FunSource in 2008.
The plaintiff alleged that he was not properly instructed on how to ride the company's mechanical bull and that he injured his finger so severely that it had to be amputated.
Cavins represented himself.
