Ingersoll-Rand blamed in asphalt roller death

A Coulterville man died after an asphalt roller overturned, crushing him, according to a recently filed lawsuit.

Deniesa K. Gresham filed a lawsuit June 6 in St. Clair County Circuit Court against Ingersoll-Rand Company, Roland Machinery Company, Delta Asphalt of Arkansas, Delta Companies and Southern Illinois Asphalt.

In her complaint, Deniesa Gresham alleges Troy Gresham was operating an asphalt roller designed by Ingersoll-Rand Company on June 6, 2009, to compress roadway at the intersection of Tilden and Ina Road in Jefferson County when the compactor flipped.

"Plaintiff's decedent was crushed by the roller and caused to die," the suit states.

Because of Troy Gresham's death, his family has lost his companionship, support, love and affection, according to the complaint.

Deniesa K. Gresham partially blames Ingersoll-Rand Company, Roland Machinery Company and Delta Asphalt for causing Troy Gresham's death, saying Ingersoll-Rand negligently designed and Roland Machinery and Delta Asphalt negligently sold the asphalt compactor without a seat restraint system. In addition, the companies negligently designed and sold a compactor that was not equipped with rollover protection and failed to warn users not to utilize the compactor without rollover protection, according to the complaint.

In addition, she says Southern Illinois Asphalt, which was in charge of supervising the paving project, negligently failed to provide Troy Gresham with a safe place to work, failed to provide an asphalt roller with proper safety equipment and failed to provide a flagman.

In her four-count suit, Deniesa K. Gresham seeks a judgment of more than $200,000, plus costs.
