Mom sues Grandma's estate over daughter's trampoline injury

A Madison County mother is suing the estate of her daughter's deceased grandmother after the child was allegedly hurt on a backyard trampoline.

Tonya McCoy, on behalf of her minor daughter, filed the lawsuit May 25 in Madison County Circuit Court against the estate of Linda Lynch.

McCoy says her daughter was visiting Lynch's Collinsville home in May 2010. McCoy says the girl was jumping on her grandmother's trampoline along with cousins. McCoys says her daughter hurt her ankle when older, larger kids allegedly fell on her.

According to the petition, Lynch was living at the home when the alleged injury happened but has since passed away.

McCoy contends Lynch was negligent for allowing more than one person on the trampoline and allegedly failing to supervise the use of the trampoline. McCoy is asking the estate to pay more than $100,000 in damages for her daughter's medical expenses along with court costs.

McCoy is represented by attorney John H. Hustava of Collinsville.

Madison County Circuit Court Case No. 11-L-492.
