Couple sues Glen Carbon roofing contractor

Bjorseth

A Buffalo, Ill. couple is attempting to recoup the more than $50,000 they say their insurance company paid them after a roofing business improperly installed their housetop.

George W. Workman III and Mabel C. Workman filed a lawsuit May 16 in Madison County Circuit Court against Nexgen Green Products of Glen Carbon.

In their complaint, the Workmans claim Nexgen failed to adequately cover their home after removing roofing, causing substantial water damages of more than $50,000.

After the Workmans sustained the damages, their insurance company, American Family Mutual Insurance Company, paid them more than $50,000 for clean-up, replacement and hotel costs, according to the complaint.

Now, the Workmans are acting as subrogees of American Family Mutual Insurance Company and attempting to retrieve the more than $50,000 the insurance company paid from Nexgen Green Products.

In their complaint, the Workmans allege breach of contract against Nexgen, saying the company negligently failed to properly protect their house with a tarp. In addition, the Workmans say the roofing company failed to use roofing felt paper as a waterproof material between roofing and sheathing, allowing water and moisture to enter their home, the suit states.

In their complaint, the Workmans seek a judgment of more than $50,000.

Scott D. Bjorseth and David A. Schott of Hoagland, Fitzgerald and Pranaitis in Alton will be representing them.

Madison County Circuit Court case number: 11-L-465.
