Two Madison County residents have filed suit against their insurance company, saying the company refuses to pay them for more than $60,000 worth of damages they sustained during a fire.
Barbara and Harlan Hogue claim they had insurance through defendant Illinois Fair Plain Association when a fire burned their property at 714 Iowa St. in Madison on Oct. 23, causing $69,800 worth of damages.
The Hogues requested money from Illinois Fair Plain Association, but have been refused payment from the insurance company, according to the complaint filed May 13 in Madison County Circuit Court.
"Defendant's refusal to pay to the Plaintiffs the amount of the loss payable under said insurance policy is unreasonable and without merit and thus Defendant is failing to perform its duty without reasonable cause," the suit states.
In addition to the money they say they are owed, the Hogues are seeking costs.
They will be represented by Morgan Scroggins of Scroggins Law Office in Granite City.
