A man's suit against a company whose mechanical bull injured his finger severely enough he claims it had to be amputated is due in court for what could be the final time next week.
Plaintiff Timothy Cavin's suit against Fun Source Inc. is set for a case management conference or dismissal May 25 at 9 a.m.
Madison County Circuit Judge William Mudge continued the matter April 25 after Cavins informed the court he was hospitalized in connection with heavy storms that hit the area.
The 2008 suit has seen little action and Fun Source has not answered Cavins' claims.
Cavins alleges that a mechanical bull he was riding in 2006 was unreasonably dangerous and the defendant failed to instruct him on how to ride it safely.
The injuries he suffered were severe enough he claims to warrant the amputation of his finger.
Cavins had moved for a default judgment in case at one point.
Cavins represents himself.
Mudge inherited the case when Madison County Circuit Judge Barbara Crowder took over the asbestos docket last year.
The case is Madison case number 08-L-792.
