Burlington Coat Factory shopper claims metal pole toppled on him

A Tennessee man claims he sustained pain and suffering when a metal pole toppled on him as he shopped at Burlington Coat Factory.

Charlie McGee filed a lawsuit May 21 in Madison County Circuit Court against Burlington Coat Factory.

McGee claims he shopped at Burlington Coat Factory in East St. Louis when a metal post propped against the wall fell on his head.

In addition to his pain and suffering, McGee lost wages, according to the complaint.

McGee blames Burlington Coat Factory for causing his injuries, saying the store negligently failed to have the shopping area clear of debris and failed to have a shopping area free of falling objects. In addition, the store failed to secure the metal post, failed to have a safe and proper environment for shoppers, failed to post proper warning signs and failed to keep the store free from loose objects, the suit states.

In his suit, McGee seeks a judgment of more than $50,000 and less than $75,000, plus costs and other relief.

Donald M. Flack of Flack Law Office in Wood River will be representing him.

Madison County Circuit Court case number: 11-L-105.
