Parties settle woman's parking lot accident case set for trial today

The parties in a suit over an accident in the parking lot of a Collinsville apartment building have settled their suit.

Madison County Circuit Judge Andreas Matoesian was set to open the case brought by plaintiff Deborah Church at trial today.

The terms of the settlement are not available in the case file.

Church is suing Tom Tyson, the executor of the estate of Diane Anderson for damages in excess of $50,000 per count of 2009 suit and costs.

Church claims that she was a passenger in a car driven by Anderson in May 2007 when Anderson crashed into a parked car.

The defendant's estate denies that there was any negligence on Anderson's part.

The parties reached the settlement March 29, according to a notation in the case's docket sheet.

Lanny Darr represents the plaintiff.

Deborah Bell Yates represents Tyson. His former attorney, Thomas Zimmer withdrew from
the case last year.

The case is Madison case number 09-L-353.
