A Bethalto woman is asking for $100,000 after allegedly falling in the parking lot of the Alton Square Mall.
Mercedena Burns filed a lawsuit March 14 in Madison County Circuit Court against Macy's Inc. and Brad Weiskopf, manager of the Macy's store. The owners and operators of the mall, May Properties Inc., White Oaks Mall Limited Partnership, Simon Property Group, Coyote Management L.P. and Coyote Alton Mall L.P. are also named as defendants.
According to the complaint, Burns was buying cosmetics at the Macy's store on Jan. 1. As she left the store and walked to her car, Burns says she tripped and fell in a hole that was allegedly filled with broken asphalt and ice.
Burns says the fall caused her to break her leg. She contends the mall parking lot had not been resurfaced for more than 30 years and was full of potholes, crumbling asphalt and depressions which made it dangerous.
Burns accuses the defendants of negligence for not keeping the conditions of the parking lot safe and for failing to warn customers of its potential danger. She asks for at least $100,000 in damages, compensatory and punitive, to pay for medical expenses and court fees.
Attorneys John Dale Stobbs and Andrew K. Carruthers of Alton are representing Burns. They ask for a jury trial.
