A Madison County woman claims she needlessly lost her thyroid after a doctor wrongly diagnosed her with cancer.
Kemberly Garver filed a lawsuit Feb. 17 in St. Clair County Circuit Court against Dr. Jeffrey T. Fierstein and Illinois ENT Associates.
In her complaint, Garver alleges Fierstein diagnosed her with papillary carcinoma and removed her thyroid to treat it. However, the surgery was unnecessary because Garver suffers from a different condition, which she failed to specify in her suit, according to the complaint.
Because of the incident, Garver suffered great pain and mental anguish and became disabled, the suit states. In addition, she experienced an impaired earning capacity, the complaint says.
Garver blames Fierstein and Illinois ENT Associates, where he worked, for causing her injuries, saying he negligently failed to properly diagnose her condition, failed to obtain a hard copy of the needle biopsy before he removed her thyroid and failed to confirm the diagnosis of papillary carcinoma.
In her two-count complaint, Garver seeks a judgment of more than $100,000, plus costs.
