A Madison County husband and wife accuse another couple of defaulting on an agreement to buy a piece of real estate.
Richard G. and June A. Gross filed a lawsuit Feb. 18 in Madison County Circuit Court against Gary Lee and Davi Dennisse Claxton.
The Grosses say, in November 2004, they agreed to sell the Claxtons a piece of property in Camden County, Mo. According to the contract, the final payment for the property was due December 2010.
The Grosses accuse the Claxtons of refusing to pay the remaining balance which allegedly totals nearly $276,000. The Grosses argue that, without payment from the defendants, ownership of property should return to them.
The Grosses, however, say the Claxtons recorded the warranty deed before the final payment was made. The couple contends that constitutes fraud.
The Grosses are asking for more than $1 million in damages. They are also requesting the Claxton be required to forfeit all payments already made on the property and to be prevented from selling the property.
