Woman's settlement with bars, tow truck company set for hearing

A woman who lost her husband and infant son in a Granite City tow truck accident is asking the court to approve a confidential settlement with all of the defendants in the case.

Madison County Circuit Judge David Hylla is set to hear the motion at 1:30 p.m. on Feb. 2.

Plaintiff Jessica Ellen Legens sued tow truck driver Mark Ikerman, his employer, Mannheim Services Corporation, Mac & Mick's Sports Bar and Grill, and Mark and Mary Eddleman, the owners of Sparky's Pub 397.

Jessica Legens alleged that the bars served alcohol to Ikerman who then answered a tow call from her husband, Donald Legens Sr.

Donald Legens Sr. had been on his way home with his son, nine month-old Donald Legens Jr., when his car ran out of gas in Granite City.

The plaintiff alleged that Ikerman was intoxicated when he answered the tow call.

Ikerman's tow truck allegedly ran into the Legens car, pushing it into Donald Legens Sr. who was outside of the vehicle.

Donald Legens Jr. was inside it at the time of the accident.

While Donald Legens Sr. was killed in the accident, his son lived briefly before succumbing to his injuries.

Jessica Legens and Regions Bank became the administrators of the Legens' estates.

The suit sought damages in excess of $50,000 per count and had sought to add punitive damages to the complaint.

The suit was set for trial Jan. 10 before the settlement was announced.

The motion for settlement approval does not provide details as to what settlement amounts may be paid or what fees the plaintiffs' attorneys may be paid.

All of the defendants are included in the settlement.

Jean Maguire and David Zevan represent Jessica Legens.

Joel Groenewold represents Ikerman.

Edward Aucoin and Donald O'Meara represent Mannheim.

Ralph Derango represents Mac & Mick's.

Daniel Hasenstab represents the Eddlemans.

The case is Madison case number 08-L-1113.
