O'Fallon accident is subject of suit

Two O'Fallon residents have filed suit against the driver who they claim rear-ended a Toyota Camry.

Debra and Charles Luster claim Debra Luster was driving her Camry east on Highway 50 at 11:39 a.m. about 260 feet east of Scott Troy Road on Nov. 22, 2008, when she encountered traffic. At the same time, defendant Martha L. Fox was driving a Ford Taurus in the same direction when she struck the rear of Debra Luster's Camry, according to the complaint filed Nov. 22 in St. Clair County Circuit Court.

Because of the accident, Charles Luster lost his wife's services, society and comfort, the suit states.

Fox negligently failed to keep a proper lookout, failed to reduce her speed and drove too fast, the complaint says.

In their complaint, the Lusters are seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
