Driver sues over collision with parked car

A woman says she was injured when her car struck a vehicle parked on a public road in Stookey Township.

Ashli R. Crabtree filed a lawsuit on Nov. 23 in St. Clair County Circuit Court against Jessica Ann Phillips and Megan R. Krueger.

Crabtree says she was driving north on Nov. 29, 2008 at about 1:44 a.m. in her 1998 Eagle Talon when shestruck a parked car having been operated by Phillips. Crabtree claim Phillips had parked her 1998 Mazda in a northerly direction in the middle of Otten Road in Stookey Township. The Mazda was owned by Megan R. Krueger.

The suit charges Phillips with negligence in failing to control her vehicle, not keeping a proper lookout, parking in traffic on a public road and parking in the middle of a roadway.

Crabtree claims the collision resulted in severe and permanent injuries and mental pain and anguish. She claims significant medical costs and lost wages.

Crabtree' s claim blames Krueger for negligence in entrusting the Mazda to Phillips and for failing to properly maintain the vehicle safely.

In her complaint, Crabtree seeks damages of $50,000 plus costs on each of two counts against Phillips and Krueger.

Thomas B. Cannady of Cannady & Katz is representing her.

St. Clair County Circuit Court case number: 10-L-616.
