Granite City car accident injury case going to mediation, had been set for trial Monday

A Granite City car accident injury case set for trial Monday will go to arbitration instead.

According to the case's docket, attorney Michael Nowack, who represents plaintiffs Jeanie and Jason Sutton, has informed the court that Monday's trial date is not needed as mediation will be conducted in his office.

The trial would have begun at 9 a.m.

Nowack's clients are suing Joshua Koller for damages in excess of $50,000 for injuries they claim to have suffered when Koller hit their car near a Granite City intersection in March 2006.

The plaintiffs contend that while Jeanie Sutton was waiting to make a left turn at the intersection of Nameoki Road and Clark Street, Koller pulled out of a parking lot on Nameoki, failed to reduce his speed, brake or look out before he hit her car.

Jason Sutton, a minor, was a passenger in the car.

Koller denies the plaintiffs' claims in his answer.

While he was originally represented by Michael Tackett, Tackett bowed out of representing Koller in December 2009.

Deborah Bell Yates represents the defendant now.

Two trials in the case set for June and September of this year were continued.

Madison County Circuit Judge Andreas Matoesian presides.

The case is Madison case number 08-L-251.
