A case over a roofer's injuries has been dismissed on the day it was set to start trial.

Madison County Circuit Judge Andreas Matoesian entered an order dismissing the suit brought by plaintiff Anthony Lovsey for want of prosecution today.

According to the order, neither Lovsey nor defendants Rehkemper and Sons Inc. and Home Structures Inc. appeared at a case management conference Nov. 17 or before the judge this morning.

Lovsey had been seeking damages in excess of $50,000 and costs.

The trial was set to begin at 9 a.m.

Lovsey filed suit against his employer, Rehkemper and Sons, after he fell off a roof in Edwardsville.

The plaintiff claimed to have suffered injuries to his legs and back.

Lovsey claimed that both defendants failed to provide him with a safe work environment.

Rehkemper filed a counterclaim against Home Structures Inc.

The defendants denied the plaintiff's claims.

Earl Hubbs, Lovsey's attorney, withdrew from the case in July.

Lovsey represented himself.

Rehkemper was represented by Michael Read.

Home Structures was represented by Catherine O'Connell.

The case is Madison case number 07-L-561.
