Ruth set to open FELA trial Tuesday

Madison County Circuit Judge Dennis Ruth is scheduled to preside over a trial in a case brought by a CSX Transportation foreman over work-related injuries.

The trial will open Tuesday at 9 a.m.

Plaintiff Russell Aper claims that CSX failed to provide a safe work environment, safe equipment and warnings at a St. Clair County facility where Aper worked.

Aper is seeking at least $50,000 for lower back injuries he claims
to have suffered while loading angle bars onto a CSX truck.

The company claims the plaintiff did not exercise ordinary care and was negligent himself.

CSX denies Aper's claims.

The last filing in the case, Sept. 13, is a request by Aper that CSX produce certain witnesses, photographs and other evidence at trial.

The case was previously part of former Madison County Circuit Judge Nicholas Byron's docket.

Amy Collignon Gunn represents Aper. Dawn Mefford was his original attorney.

Richard Nash represents CSX.

The case is Madison case number 07-L-592.
