Edwardsville couple sues over injuries at Sam's Club concession

An Edwardsville couple is suing Wal-Mart, accusing the retail giant of allowing a slippery floor.

Sharon and Joseph Militello filed the lawsuit against Wal-Mart Stores, doing business as Sam's Club, Sam's East Inc. and Sam's West Inc. on Sept. 7 in Madison County Circuit Court.

Sharon Miletto says she was shopping at the Sam's Club in O'Fallon in September 2009 when she slipped and fell near the exit door. The area is close to a concession stand where, Miletto says, food and drinks are consumed.

The Militellos accuse Wal-Mart of negligence for failing to maintain the Sam's Club to ensure customers' safety, failing to warn customers of potential hazards on the floor and for failing to provide adequate supervision of high-traffic areas.

Sharon Militello is asking for damages in excess of $50,000 for medical expenses, pain and suffering and loss of a normal life.

Militello's husband, Joseph, is suing for loss of consortium. He also seeks damages in excess of $50,000.

Attorneys Gordon R. Broom and Daniel Lytle, of Edwardsville, are representing the couple.
