A St. Clair County couple is suing a man they say caused a crash that has left them permanently injured.
Betty and Charles Wieland filed the complaint against Zachary Miles Aug. 16 in St. Clair County Circuit Court.
The Wielands accuse Miles of causing a crash that allegedly injured the couple in August 2008. According to the suit, Charles Wieland was driving a Toyota Camry on North Main Street near the intersection of Sunset Court in Smithton when Miles, driving a Ford Explorer, ran into him. Betty was a passenger in the Camry.
The Wielands claim the crash was a direct result of Miles' negligence in failing to keep his vehicle under control, failing to pay attention to traffic, failing to obey traffic signs and failing to use evasive action to avoid the collision.
Betty Wieland says she suffered serious and permanent injuries to her face, head, neck, chest and back. Both say they have incurred numerous medical expenses since the crash.
In addition to the financial strain, Betty says she has suffered pain and mental anguish as a result of the crash. She says she is disabled and no longer able to live a "normal life" Betty is asking the court to award her damages of more than $50,000 along with court costs. Charles is asking for damages not to exceed $50,000.
Both Charles and Betty Wieland are also asking to be compensated for financial and emotional burden of their spouse's injuries. Charles is asking for at least $50,000 for the loss of the affection, companionship and consortium of his wife. Betty is seeking $15,000 to $50,000.
Steven E. Katzman, of Bellville, is representing the Wielands. They are demanding a jury trial.
