Man pushed down ramp in walker sues Alton over raised asphalt

A Wood River man claims he sustained injuries to his ankle, hip and neck after toppling over excess asphalt that had been poured at the end of a wheelchair ramp.

Jerry Allan Robins filed a lawsuit Aug. 18 in Madison County Circuit Court against the city of Alton and Alton's Public Works Department.

Robins claims a pedestrian pushed him in his walker down a ramp on West Fourth Street when he encountered asphalt that sat one inch higher than the bottom of the ramp, causing Robins to fall.

In addition to his injuries, Robins experienced pain and suffering; incurred medical costs and suffered disability, according to the complaint.

He blames Alton for causing his fall, saying the city negligently failed to maintain the sidewalk and ramp in a safe manner, failed to take steps to make the dangerous asphalt condition safe, failed to warn Robins of the dangerous condition and failed to maintain a safe passageway between the sidewalk and the ramp.

In his two-count complaint, Robins seeks an unspecified judgment, plus costs and other relief the court deems just.
