Horse charged into vehicle, personal injury suit claims

A St. Clair County woman has filed suit against the owners of a horse that she says charged into her vehicle, causing her to sustain injuries.

Melva Lee Yates claims she was driving her 1995 Pontiac Grand Am north on Summerfield South Road in Lebanon on Nov. 16, 2008, when a horse owned by defendants Gerald W. and Connie Cummings charged her vehicle.

Because of the incident, Yates sustained injuries to her back, right hip, right knee and other body parts; incurred medical costs; and suffered great pain and mental anguish, according to the complaint filed July 26 in St. Clair County Circuit Court. In addition, she missed numerous working days, the suit states.

The Cummings negligently failed to keep their horse under proper control, failed to keep their horse penned in a corral and failed to take adequate measures that would have prevented the horse from injuring Yates, the complaint says.

In her four-count complaint, Yates is seeking a judgment of more than $200,000, plus costs.

She will be represented by Gary A. Mack of the Law Offices of Gary A. Mack in Belleville.
