The defendants in a defamation of character suit filed by a former hospital nurse who claims rumors led to his firing are asking that the case be thrown out.

Madison County Circuit Judge Dennis Ruth is set to hear the motion to dismiss filed by Kathryn Hartmann, Saint Anthony's, E.O. Kiepher and Cindy Drainer Friday.

The motion had previously been set last month but was pushed off until this Friday at 9 a.m.

Plaintiff John Doe is seeking at least $50,000, costs, lost wages and other damages.

He claims Hartmann falsely accused him of molesting a patient in April 2009 and that Saint Anthony's then fired him based on the claims.

Doe claims that the charges were false and were thrown out by the Illinois Department of Financial and Professional Regulation.

Doe also claims the Alton hospital discriminated against him due to his sexual orientation.

The defendants claim in their motion to dismiss that Doe's claims don't meet the legal standards need to go forward.

Doe is represented by Jacqueline Brandenburg-Rees and Bob Perica.

The defendants are represented by Jill Luft, Edward Bott and Melanie Renken.

The case is Madison case number 10-L-370.
