A Tennessee man has filed suit against Burlington Coat Factory Warehouse of East St. Louis where he claims he was shopping when a metal post fell on his head and shoulders.
Charlie McGhee claims he visited the store on May 24, 2008, when the incident occurred.
"The Defendant had a metal post propped up against the wall without securing it," the suit states.
Because of the incident, McGhee suffered severe injuries, pain and suffering and lost wages, according to the complaint filed May 21 in Madison County Circuit Court.
Burlington Coat Factory negligently failed to adequately have the shopping area cleared of debris, failed to maintain a shopping area free from falling objects, failed to have a metal post secure from falling on customers, failed to have a safe and proper environment for shoppers and failed to have proper warning signs posted of loose objects in the shopping area, the complaint says.
In his complaint, McGhee is seeking a judgment of more than $50,000 but less than $75,000, plus costs and other relief the court deems just.
He will be represented by Donald M. Flack of Flcack Law Office in Wood River.
