A Swansea nursing home wants the court to order the surviving wife of one of its deceased patients to pay money allegedly owed for her husband's care.
Rosewood Care Center of Swansea filed a lawsuit April 21 in St. Clair County Circuit Court against Sue Lysakowski.
Rosewood claims Sue Lysakowski's husband, Lloyd Lysakowski, entered into an agreement with Rosewood on Aug. 12, 2005, in which he arranged for it to provide him with nursing care in exchange for payments to it.
Lloyd Lysakowski lived at the nursing home from Aug. 12, 2005, until July 16, 2006, and has since died, according to the complaint.
However, Rosewood has never received all the money it says the Lysakowskis owe it for treatment of Lloyd, the complaint says.
"After crediting the defendant for all payments made to Rosewood for any of Lloyd Lysakowski's stay at the facility there is due and owing Rosewood the amount of $37,784.09," the suit states. "There is due and owing Rosewood the amount of $17,294.75 for Lloyd Lysakowski's stay at the facility from Aug. 3, 2006, through November 17, 2006, plus interest of 18% per annum and attorney fees."
Knowing she owed Rosewood money, Sue Lysakowski transferred property to her son below its fair market value on April 18, 2006, Rosewood claims.
In addition to the money it says Sue Lysakowski owes it, Rosewood seeks costs and other relief the court deems just. It also wants the court to set aside the transfer of the property from Sue Lysakowski to her son and to grant a lien against the property located at 818 Park Ave. in Belleville for $55,078.84.
